Send us your favourite photos -- a shot of a recent vacation, a fabulous day at your cottage  - pretty much anything, really. For each issue of Lifestyler magazine, we’ll choose a group of finalists and a winner. The winner will see his or her winning photograph printed on the last page of Lifestyler magazine. The photographs submitted by the finalists will be posted online. Send your shot, along with a description of the shot and your name, address and telephone number, to media@lifestylermag.com by Jan. 15, 2012 to be entered in the contest for the next issue.

CONTEST RULES

SPONSOR

1. The Sponsor of the Lifestyler™ Editor's Choice Last Page Photo Contests [collectively, “the Contest”] that are governed by these Contest Rules [“these rules”] is Evolusent Inc. [“Sponsor”]

PERIODIC CONTESTS

2. Starting with the January, 2012 issue and ending with the January 2013 issue, there shall be a contest held for each issue of Lifestyler magazine. 

TERM

3. The term of the contest for each issue of Lifestyler magazine ends at 9:00 am Eastern Standard Time (EST) on the 15th day of the month in which said each issue is released and begins at 9:00 am EST on the 15th day of the month of release of the immediately preceding issue of the magazine. 

CONTESTS OF SKILL 

4. The Contest is skill-based and chance plays no part in the determination of winners and finalists.

WHO MAY ENTER
5. Each contest is open only to Canadian citizens who have reached the age of majority in their jurisdiction of residence at the time of entry and who do NOT reside in the Province of Quebec. Employees of Sponsor and its subsidiaries and affiliates, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such employees, whether or not related are not eligible. THE CONTEST IS VOID IN THE PROVINCE OF QUEBEC AND WHERE OTHERWISE PROHIBITED.

HOW TO ENTER

6. For the purposes of these rules, a “valid entry” consists of the following: a photograph; and the name, address and telephone number of a person to whom the Contest is open. The person named in a valid entry sent by that person to media@lifestylermag.com during the term of a contest shall be considered an entrant in that contest.

7. There is no limit on the number of entries per person. Each entry must comply with the following requirements (the "Photograph Requirements"):

i. Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted. The photograph need not be taken with a digital camera; scans of negatives, transparencies, or photographic prints are acceptable. All digital files must be 300dpi, 5 megabytes or smaller, must be in JPEG or JPG format, and must be at least 1,600 pixels wide (if a horizontal image) or 1,600 pixels tall (if a vertical image).

ii. Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided, entrants must be prepared to provide a release form as described below in "Releases" When photographing the work of others, it must be as an object in its environment and not a full-frame close-up of another person's art.

iii. The photograph, in its entirety, must be a single work of original material taken by the entrant. By entering a contest, entrant represents, acknowledges, and warrants that the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the photograph.

iv.The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content.

8. By submitting an entry, each entrant agrees to the rules and warrants that his or her entry complies with all requirements set out in these rules.

ODDS:

9. With respect to each contest, the odds of being selected as a potential winner depend on the total number and quality of entries received during the term of said each contest.

RELEASES

10. If the photograph submitted as part of an entry contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence, the signature of a parent or legal guardian is required on each release. 

11. Each entrant must be prepared to provide, within five (5) calendar days of receipt of a request from Sponsor, a signed personal release from all persons who appear in the photograph submitted, authorizing Sponsor and its licensees ("Authorized Parties") to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and with the promotion of the Contest, in any media now or hereafter known.

12. Each entrant must be prepared to provide, within five (5) calendar days of receipt of a request from Sponsor, a signed artist release from the copyright owner of any sculpture, artwork, or other copyrighted material that appears in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and with promotion of the Contest, in any media now or hereafter known.  

13. Finally, each entrant must be prepared to provide, within five (5) calendar days of receipt of a request from Sponsor, a signed location release from the owner of any private property included in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display, and create derivative works of the entry in connection with the contest and promotion of the Contest, in any media now or hereafter known.

14. All releases must be in the form provided by Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

15. For the purposes of these rules, if the Sponsor sends to an entrant, at the email address used by the entrant for his or her submission, a request, the entrant will be deemed to be in receipt of such request on the day the email was sent by the Sponsor.

JUDGING

16. From amongst the valid entries for each contest, a potential winner will be chosen by the then-current editor of Lifestyler magazine by the 18th day of the month in which said each issue is released; the editor may also choose any number of finalists from amongst the valid entries. The decisions of the editor are final and binding. 

WINNING

17. The potential winner will be notified by email. NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATE POTENTIAL WINNER. If the potential winner, within five (5) calendar days of such notification, satisfies the requirements for winning, he or she shall be deemed to be the winner of the contest.  Failure to timely satisfy the requirements for winning may result in disqualification and selection of a new potential winner.

REQUIREMENTS FOR WINNING 

18. To satisfy the requirements for winning, the potential winner must:

(1) correctly answer, unaided, a time-limited, arithmetical, skill-testing question, to be administered online;

(2) timely provide any releases requested by the Sponsor pursuant to § 11-13; and

(3) provide, within five (5) calendar days of receipt of a request from Sponsor, a signed copyright release, authorizing Authorized Parties to reproduce, distribute, display, and create derivative works of the entry in connection with the Contest and with the promotion of the Contest, in any media now or hereafter known

PRIZES

19. The winner of the contest will see his/her name, city of residence and winning photograph printed on the last page of the Lifestyler magazine for which said each contest has been held.  

20. No prize transfer, assignment, or substitution by winners permitted. If a prize is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law.

LICENSE

21. By submitting an entry, the entrant grants an irrevocable, perpetual, worldwide non-exclusive license to the Authorized Parties to reproduce, distribute, and create derivative works of the photograph submitted as part of that entry, in any media now or hereafter known, including, but not limited to: publication on www.lifestylermag.com; display at a potential exhibition of winners; publication of a book featuring select entries; and publication in Lifestyler magazine. Entrants consent to the Sponsor doing or omitting to do any act that would otherwise infringe the entrant’s “moral rights” in their entries; entrants specifically waive all moral rights in the photographs submitted as part of their entries. Display or publication of any entry on an Authorized Party’s website does not indicate the entrant will be selected as a winner. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made by entrant in connection with the Contest, or choose not to do so, at their sole discretion. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

LIMITATION OF LIABILITY

22. All entrants agree to release, discharge, and hold harmless Sponsor and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in the contest and the acceptance and use, misuse, or possession of any prize awarded hereunder.

23. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Contest entries or entry forms; or alteration of entries or entry forms. Sponsor is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants' or any other persons' computers related to or resulting from participation, uploading or downloading of any materials related to in this Contest.

CONDITIONS

24. THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the Province of Ontario and the forum for any dispute shall be in the Province of Ontario, Canada.  To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or on connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries shall be voided if the Sponsor determines the photograph to be otherwise than an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

25. By entering, entrants also agree (a) to be bound by these rules; (b) that the decisions of the editor is final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins that Sponsor may use the winning photograph and each winner's name in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal/provincial/territorial and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. 

26. The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant's identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST

27. If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, Trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsor elects to cancel or terminate a contest, Sponsor will not retain any rights in the photographs submitted during the term of that contest. 

WINNERS LIST

28. With respect to each contest, the name of the winner will be published along with the winning photograph in the issue of Lifestyler magazine for which the contest was held.   Back issues of the magazine are available for online inspection at www.lifestylermag.com

DATA PRIVACY

29. Entrants agree that personal data, especially names and addresses of entrants, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these rules. The data may also be used by the Sponsor in order to verify the participant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the Contest. Participants have the right to access, review, rectify, or have removed any personal data held by Sponsor by writing to Sponsor at 2680 Matheson Boulevard East, Suite 202, Mississauga, Ontario L4W 0A5.  Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

USE AND DISCLOSURE

30. Sponsor uses and discloses information which it collects as follows: 

• To present entrants with advertising that may be relevant;

Sponsor may share personally identifiable information with its related companies;

Sponsor may share personal information with third-parties specifically engaged to provide services to Sponsor;

Sponsor will cooperate with legal authorities, and may in some circumstances be required to disclose personally identifiable information in response to requests from law enforcement authorities, or in response to a subpoena or other legal process.  Sponsor can also turn over information about entrants if it believes it must in order to prevent a violation of the law, and entrants consent to this.  Entrants also consent to disclosure of personal information in the course of legal proceedings if Sponsor is legally required to do so, if Sponsor reasonably believes that doing so may mitigate liability, or if doing so will assist us Sponsor in enforcing its legal rights;

Sponsor may share personal information in connection with a corporate transaction, such as a divestiture, merger, consolidation, or asset sale, and in the unlikely event of bankruptcy; and

Sponsor may aggregate personal information from all entrants and provide that information in the aggregate to other parties, including advertisers, for marketing and promotional purposes.
